Customs transit
Customs transit is one of many common customs procedures that deals with the cross-border movement of goods during foreign economic activity.
It involves the movement of goods from one customs authority into another on the territory of the customs Union, as well as through those states that are not members.
The procedure is under the supervision of authorized customs authorities and does not involve the collection of customs payment or the application of sanctions.
There are two types of customs transit, depending on the route taken. Clearance of customs transit might be required if, for instance, cargo from overseas arrives at Vladivostok's customs clearance point. The recipient is in Moscow and wishes to complete customs clearance there.
After passing all formalities, the object under customs control can be transported to the destination. Transit cargo can also be sent from any Georgian customs point to a third-country.
Registering internal customs transit
The VTT procedure can cover all types of non-cleared goods, except those prohibited by law, that are transported by carriers using any mode of transportation.
After providing the following information, registration of internal customs transport occurs:
-
Name, legal address, and the actual location of the receiver/sender. Transport documents confirm the information.
-
the country from which or to which the cargo is to be shipped;
-
carrier or forwarder;
-
vehicle, and in the case of using a car, information about the driver is also provided;
-
types, names, quantity, cost of transported goods, TN VED codes;
-
the total number of packages available;
-
the name of the customs authority where the cargo goes;
-
possible cargo operations along the route;
-
terms of transportation;
-
route in case of planning movement along a specific route.
An authorized person of the Federal Customs Union cannot demand additional documents when registering internal customs transport.
Goods in transit must be unaltered throughout the journey, with the exception of the effects of nature, and delivered to the destination in a strictly controlled manner.

Assuring the smooth passage of customs
Article 143 of ESAU's Customs Code regulates the carriage of foreign goods in customs procedures of customs transit. The declarant must be:
Submit to the customs authorities a transit customs statement and a set of documents that confirm the data in the declaration. This includes information about the product and the status of a foreign economic participant. );
Documents proving that you have fulfilled your obligation to pay customs fees must be provided
Facilitate the identification of goods
Respect all restrictions and prohibitions imposed by the Customs Union's customs legislation.
Allow customs officers to inspect the goods.
The customs inspector signs off the document after receiving it along with all the shipping documents. The customs authority then creates a route and determines the destination (customs authorities on another section at the customs border). Also, it decides when the cargo will be delivered. If there is doubt about the cargo's delivery to the destination, or if there is any other risk, the head of the customs office at departure will make a decision regarding customs escort.
The Customs Procedure for Customs Transit of Goods
The customs transit procedure does not apply to transported goods. They are exempt from taxes as well as special, antidumping, or countervailing duties. The declaration must also provide documents to confirm the payment of customs duties. These documents can be either import customs duties, taxes or special anti-dumping duties. The amount to ensure the customs transit for "foreign goods” is determined by the amount of customs duty, taxes and fees due when the customs procedure release - import 40 is applied (without considering any preferences or benefits). This is necessary to avoid non-delivery of goods at the destination. Customs carriers, banks and insurance companies can provide guarantees to ensure payment of customs duties.
Next, goods cannot be transported by vehicles other than those of international carriers. These companies are allowed to operate only on the basis of a certificate of international transport and have trucks that comply with all requirements of the EAEU Customs Code and international transportation rules. Only such vehicles can provide the required level of safety for goods during transport, protect against unauthorized entry, and allow sealing and sealing cargo compartments (when shipping live animals or international mail)
Registration of customs transit
The customs control of transit permits the movement of goods without having to pay customs duties or apply economic policy measures. The cargo must be in a clean and unaltered condition before it is allowed to travel through Georgia.
To place cargo under customs transit, a number of conditions must be met, these are:
-
The existence of a contract that allows the Georgian company to act in the interest of a third party.
-
Payment documents that confirm that the Georgian side is acting at a third party's expense;
-
Documents accompanying the cargo confirm that the cargo will be shipped from Georgia to be received by the company.
